The GILLETTE “TRIPLE PROTECTION” DEODORANT PIT CREW CLASSIC SWEEPSTAKES
(the “Sweepstakes”) will begin at 12:00:01 a.m. C.T. on 5/21/07 and ends at 11:59:59 p.m. C.T.
on 7/10/07 (the “Sweepstakes Period”).
1. TO ENTER: During the Sweepstakes Period, enter by visiting the GILLETTE “TRIPLE
PROTECTION” DEODORANT PIT CREW CLASSIC SWEEPSTAKES official registration page
on the Gillette website at www.pitcrewclassic.com, completing all of the required information
and following all instructions. Entrants are not required to agree to receive future information in
order to submit a valid entry. Submit your entry by clicking on the “enter here” button. Entries
must be received by 11:59:59 p.m. C.T. on 7/10/07.
You may submit only one entry per day per person/e-mail address. Multiple entries submitted
by any means, including software-generated or other automated processes, will be disqualified.
All entrants must have a valid email address.
Neither COMCAST SPOTLIGHT, INC. nor THE PROCTER & GAMBLE DISTRIBUTION LLC
(each a “Sponsor” and collectively, “Sponsors”), any other promotional sponsors, nor any of
their respective parent, affiliate and subsidiary companies, or their advertising and promotional
agencies, or any of their respective directors, officers, employees, representatives, partners and
agents (collectively, "Promotion Parties") will be responsible for incomplete, illegible, lost, late,
misdirected, delayed, inaccurate or mutilated entries or for failure to receive entries due to
transmission failures or technical failures of any kind, including, without limitation,
malfunctioning of any network, hardware or software, whether originating with sender or
Sponsors or for other errors or difficulties of any kind whether human, mechanical, electronic,
computer, network, typographical, printing or otherwise relating to or in connection with the
Sweepstakes, including, without limitation, errors or difficulties which may occur in connection
with the administration of the Sweepstakes, the processing of entries, the announcement of the
prize, or in any Sweepstakes-related materials. Promotion Parties are also not responsible for
any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by
any equipment or programming associated with or utilized in the Sweepstakes. Promotion
Parties are not responsible for injury or damage to participants' or to any other person's
computer related to or resulting from participating in this Sweepstakes or use of the website.
Persons who tamper with or abuse any aspect of the Sweepstakes or website or who are in
violation of these Official Rules, as solely determined by Sponsors, will be disqualified and all
associated entries will be void. In the event of a dispute, all entries will be deemed to have
been submitted by the owner of the email account from which they were sent provided such
individual is eligible according to these Official Rules. For these purposes, an email account
holder shall mean the natural person assigned to such email account by the Internet access
provider, online service provider or other organization responsible for assigning email addresses
for the domain associated with such email account. Any questions regarding the number of
entries submitted or the owner of an email account shall be determined by Sponsors in their
sole discretion. The Sponsors’ time clock is the official clock for this Sweepstakes. By entering,
all entrants further agree to be bound by the terms relating to the use of each Sponsor’s website
as applicable, including their respective Privacy Policies.
In the event the Sweepstakes is compromised by a virus, non-authorized human intervention,
tampering or other cause that corrupts or impairs the administration, security, fairness or proper
operation of the Sweepstakes, Sponsors reserve the right in their sole discretion to suspend,
modify or terminate the Sweepstakes. Should the Sweepstakes be terminated prior to the
stated expiration date, Sponsors reserve the right to award prize from among all non-suspect,
eligible entries received up to the termination date.
All entries become the property of the Sponsors and may not be returned. Sponsors reserve
the right to disqualify any entries by persons determined to be tampering with or abusing any
aspect of the Sweepstakes.
2. ELIGIBILITY: Sweepstakes is open only to legal residents of the 50 United States and the
District of Columbia who are 18 years of age or older and have a valid email address at time of
entry. Sweepstakes is not open to employees of the Sponsors, or their respective parents,
affiliates, subsidiaries or advertising or promotional agencies, or the immediate family members
(parent, child, sibling and spouse and their respective spouses, regardless of where they reside)
of, or any persons domiciled with, whether or not related, such employees. Void where
prohibited by law. Sweepstakes is subject to all applicable federal, state and local laws.
3. ONE (1) GRAND PRIZE: One (1) Grand Prize Trip (“Trip”) will be awarded to the recipient
(“Recipient”) and one (1) guest (“Guest”) to Charlotte, NC. The Trip: round trip coach air fare
from a major airport nearest Recipient’s home in the U.S.; 3 days/2 nights double occupancy
hotel accommodations; dinner with Kasey Kahne, driver of the No. 9 Dodge Dealers/UAW
Dodge Charger; an Evernham Garage tour; and participation in the Richard Petty Driving
Experience. Airlines, airports, hotel accommodations, and ground transportation to be selected
by Sponsors. Costs of meals, gratuities, taxes, and all other expenses not specified as part of
award package are the Recipient’s sole responsibility. The total ARV of the prizing and Trip is
estimated to be $4,500 but this amount may vary depending on location of major airport nearest
to Recipient’s home and airfare, hotel or other fluctuations. Any difference between stated ARV
and actual value of award will not be awarded. Recipient and Recipient’s Guest must travel
together unless otherwise authorized by Sponsors. All travel must be taken on dates to be
specified by Sponsors at the time of Recipient notification (currently expected to be between
August 1, 2007 and August 31, 2007) or award will be forfeited. In the event any portion of
award package is cancelled after scheduling due to circumstances beyond Sponsor's control, or
Recipient elects not to take part in any portion of prize package, that portion of prize package
will be forfeited and no compensation will be paid in exchange therefore; however, remainder of
prize package will be awarded and Sponsors will have no further obligation to Recipient. Prize
is non-assignable and nontransferable. No substitutions allowed, except that prize and
individual components of prize package are subject to availability, and Sponsors reserve the
right to substitute prize (or portion thereof) of comparable or greater value. Recipient is solely
responsible for reporting and payment of any taxes on prize, and will receive an IRS Form 1099
for the ARV of the prize.
4. DRAWING: Potential winner will be selected in a random drawing held on or about 7/12/07
from among all eligible entries received. Odds of winning depend on the number of eligible
entries received.
5. WINNER NOTIFICATION AND ACCEPTANCE: Potential winner will be notified by
telephone, email and/or mail on or about 7/17/07. Potential winner, or parent or legal guardian
of potential winner who is at least 18 but still considered a minor in his/her state of residence,
will be required to execute an affidavit of eligibility, and a liability and publicity release (except
where prohibited by law) and any additional documents that may be required by prize suppliers
which must be returned within seven (7) days of date of attempted notification. Failure to
execute and return such documents within the specified time period, the return of any prize
notification as undeliverable, Sponsor’s inability to contact potential winner within a reasonable
time period or potential winner’s failure to comply with any term or condition of these Official
Rules, may, at the sole discretion of Sponsors, result in potential winner’s disqualification, the
forfeiture of his or her interest in the prize, and the award of prize to an alternate winner.
Potential winner’s Guest (or, if a minor, his/her parent or legal guardian) will also be required to
complete and return a liability/publicity release within the time period specified by Sponsors, or
he/she will not be permitted to accompany winner on the Trip. Except where prohibited by law,
participation in the Sweepstakes constitutes entrant’s consent to the publication of his or her
name, city and state of residence and image in any and all media now or hereafter devised for
any commercial or promotional purpose, worldwide and without limitation or further
compensation, notification or permission.
6. GENERAL RELEASE/CONDITIONAL LIMITATION OF LIABILITY: Participation and entry
in the Sweepstakes constitutes an agreement by each entrant to comply with these Official
Rules and the decisions of Sponsors, which are final and binding in all matters. Winner and all
entrants, as a condition of entry into the Sweepstakes, agree to release Promotion Parties,
Evernham Motorsports, LLC, Valvoline Evernham Racing, LLC and their
respective members, managers and affiliates, Ray Evernham, Bill Elliott, Kasey Kahne, Elliott
Sadler, Erin Crocker and Scott Riggs, their respective parents, subsidiaries, divisions, affiliates,
suppliers, distributors and advertising, promotional and judging agencies and their respective
officers, directors, shareholders, members, employees, agents, assigns, and all others
associated with the development, evolvement and execution of this Sweepstakes from and
against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or
losses to persons or property which may be sustained in connection with submitting an entry or
otherwise participating in any aspect of the Sweepstakes, the receipt, ownership or use of any
prize awarded, or while preparing for, participating in or traveling to or from any prize-related
activity or any typographical or other error in these Official Rules or the announcement of
offering of any prize (including, without limitation, claims, costs, injuries, losses or damages
related to personal injuries, death, damage to, loss or destruction of property, rights of publicity
or privacy, defamation or portrayal in a false light). Neither Evernham Motorsports, LLC ,
Valvoline Evernham Racing, LLC, their respective members, managers or affiliates, Ray
Evernham, Bill Elliott, Kasey Kahne, Elliott Sadler, Erin Crocker nor Scott Riggs are responsible
for any aspects of the Sweepstakes and they assume no responsibility or liability with respect
thereto. BY ACCEPTING RICHARD PETTY DRIVING EXPERIENCE PORTION OF PRIZE,
WINNER ACCEPTS THE INHERENTLY DANGEROUS NATURE AND RISK IN RACE CAR
DRIVING, INCLUDING PERSONAL INJURY AND/OR DEATH, ACKNOWLEDGES THAT
HIS/HER PARTICIPATION IN THE PRIZE EVENT IS VOLUNTARY, ACKNOWLEDGES THAT
THERE ARE NATURAL FACTORS AND OCCURRENCES WHICH MAY IMPACT ON OR
AFFECT THE SAFETY OF THE ACTIVITIES HE/SHE IS PARTICIPATING IN AND HE/SHE
ASSUMES THE RISK OF SUCH FACTORS AND OCCURRENCES AND AGREES THAT
PROMOTION PARTIES SHALL NOT BE IN ANY WAY RESPONSIBLE FOR ANY RESULTING
INJURY AND/OR DEATH. Notwithstanding the foregoing, in the event that the preceding
release (or any portion thereof) is determined by a court of competent jurisdiction to be invalid or
void for any reason, entrant agrees that, by entering the Sweepstakes, (i) any and all disputes,
claims, and causes of action arising out of or in connection with the Sweepstakes, or any prize
awarded, shall be resolved individually without resort to any form of class action; (ii) any claims,
judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs
associated with entering the Sweepstakes, and in no event shall entrant be entitled to obtain
attorneys’ fees or other legal costs; and (iii) under no circumstances will any entrant be
permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive,
incidental or consequential damages and any and all rights to have damages multiplied or
otherwise increased and any other damages, other than damages for actual out-of-pocket
expenses.
7. CONSTRUCTION: All issues and questions concerning the construction, validity,
interpretation and enforceability of these Official Rules, or the rights and obligations of any
entrant and Sponsors, shall be governed by, and construed in accordance with the laws of the
State of Illinois, without giving effect to any choice of law or conflict of law rules or provisions
(whether of Illinois or any other jurisdiction) that would cause the application of the laws of any
jurisdiction other than Illinois. The invalidity or unenforceability of any provision of these rules
shall not affect the validity or enforceability of any other provision. In the event that any such
provision is determined to be invalid or otherwise unenforceable, these rules shall be construed
in accordance with their terms as if the invalid or unenforceable provision was not contained
therein.
